Apple sued over iPod nano scratches
A class-action lawsuit has been filed against Apple over the iPod nano’s tendency to get scratched easily. The complaint was filed Wednesday in the U.S. District Court in the Northern District of California in San Jose on behalf of nano owner Jason Tomczak and others who have purchased the device.
Â
The lawsuit alleges that nano screens “scratch excessively during normal usage, rendering the screen on the nanos unreadable, and violating state consumer protection statutes… and causing Plaintiff class members to incur loss of use and monetary damages.â€?
The plaintiffs are seeking damages including the retail price paid for the nanos, statutory and punitive damages, attorneys’ fees, and even a share of nano profits, according to the Red Herring.

I just got one for Christmas, and mine got a nice big scratch right down the screen from putting in and taking it out of a very nice case. I literally took it out of the brand new box from apple, inserted it in a soft plastic protective case, and the unit scratched.
I’m annoyed enough to take it to an Apple store and see if they’re replace it (which they should if it’s only 1% that have these problems as they claim). But if they don’t, you don’t notice the scratch when it’s in the case and the backlight on on the screen.
For people who say “it will get scratched” - I have a 3G iPod which I’ve beat around a bit and it has very slight wear and tear that’s normal, the nano has scratches right down the front that are pretty noticeable.

Igot a custom red video Ipod from Colorwarepc.com. I didn’t want to get a silicone case cause I wanted to show off the paint job, so I got the clear plastic hard case. The ipod fits soo tight in there that the case left lint imprints in the screen and paint. I would have to agree that they use some real cheap material for something that’s kinda pricey.
