Eminem sues Apple over iTunes ad

“Rapper Eminem’s music publisher is suing Apple Computer Inc., claiming the company used one of the hip-hop superstar’s songs in a television advertisement without permission.

Eight Mile Style filed the copyright infringement suit late last week against Apple, Viacom Inc., its MTV subsidiary and the TBWA/Chiat/Day advertising agency.

At issue is an ad for Apple’s iTunes pay-per-download music software, in which a 10-year-old sings Eminem’s “Lose Yourself.” The suit claims the commercial aired on MTV beginning in July 2003 and ran numerous times for at least three months. It also appeared on Apple’s Web site.”

Theses comments are Mac fanboy-dom at it’s best. 

Apple stole music.  They’ll settle, or get beat down in court.  Fair use doesn’t cover commericials for for-profit products, never has.  Liking rap or rappers has no relevance whatsoever, but it’s nice to see that kind of ignorance displayed as well.  Nothing like an “artist” denouncing an entire genre.  Sounds a lot like jealousy from over here.

THIS IS NOT COPYRIGHT INFRINGEMENT! His image is never shown, his music is never played. In fact, there was no association with Eminem represented or implied in any way until Eminem himself made these riduclous charges. This is simply Eminem trying to stay in the news in an way possible (certainly not artistic merit) and the courts will recognize that. Apple has absolutely nothing to worry about here.

Using a part of a song in a commercial venture without permission is in fact copyright infringement.  Even if someone else covers it, they still have to pay a licensing fee.  If they paid it, they’re safe.  If not, they’re screwed.

this whole discussion of whether rap, or opera for that matter, is valid is a little off topic.  But seriously, Chris, your evaluation of “fair use” is patently absurd.  and false.  i do not know how or why you allowed yourself to be swindled if you did.  please contact ascap or bmi immediately, perhaps they can at least get you set to make some money on future compositions.  fair use does not in any way apply to commercial, or even for that matter, educational productions of any kind.  if you sell a product, you compensate the artist.  period.  it actualy doesn’t matter if it’s “non-commercial”, educational material, either.  if you don’t believe me, ask yourself: if advertisers could use songs for free, why in god’s name would a capitalist entity ever pay for it?  why do companies license music for millions of dollars?  why are composers ever hired to create music. 
my guess, with all due respect, is that chris is exaggerating his involvement with the music biz just a tad.

Nice going man. 2Pac and Biggie have got to be two of of the greatest artists to ever touch a microphone. If you werent so musically biased you’d see their song writing ability. Its just sad that people can hate one genre so much that they try to prove a point, but just yell useles jibberish.

Oh well your loss in the end. Listen to a 2pac album, or download it off your fancy iTunes music store.

Apple makes a mistake and everyone ignores it completely. Its called the LAW. Just because apple is your favourite company, doesnt mean they have the right to grab other people’s lyrics and use them to market the monopoly of an mp3 player, the iPod has become.

No wonder the world is in such a mess, people cannot follow rules.

this whole thread is basically people hating eminem / rap and going on about that.  It doesnt matter who the artist is or what music it is, it is basically the fact that apple are being accused of using somebodys music without permission.  i have not seen the ad so cant really comment, but in my own opinion at first i was with eminem but after hearing the decription of the ad (someone singing, not eminem, no music) i am with apple.  then again if it is recognisable as eminems song then i cud be with eminem again….argh i dont know

You ignorant dolt. If you don’t know what GO GO is then you should really throw away all of your “rap” songs because you don’t deserve to own them. That comment alone shows how musically naive you are. And on your other point - bitter? LOL! Why would I be bitter? I never got screwed over on anything relating to music.


Second, to Matt -

Now, replace those 2 thugs with, say, Marvin Gaye, Robert Plant,  hell - even Celine Dion, and you might have an argument. Otherwise, your comments show your total lack of musical knowledge and your overall incredible stupidity.

If you want to defend rap, then throw up people like Nelly. At least Nelly can actually SING while he is alliterating.

Matt - one other thing. If you read all of my posts you would see that I never dissed rap in total - only this thug rap that is popular these days.

I love old school rap - Grandmaster Flash, Kool Moe Dee, KRS 1,  Doug E Fresh, Public Enemy, etc. At least those guys had something to say.

So don’t think I don’t like the genre - I just hate what it has become. As I said, just a bunch of egotistical, NO TALENT,  drug dealing criminals that glorify drugs, murder, treating women like crap, and looking at education as being useless. It is all about “gettin paid”, “smacking b i t ch es”,  “pullin out my nine”, and flashing the bling bling”. Not only that but they have MURDERED the English language.

the point still remains, this article and discussion should be about wether eminem is right to sue apple over this advert.

arguing about different kinds of music is just pathetic and sad (unless ur kids in a playground).  And chris i really dont know what gogo music is, maybe it is called something else in the uk?
