Eminem to battle Apple over copyright

“A federal judge says rapper Eminem’s copyright infringement claims over use of his song “Lose Yourself” in a commercial for Apple Computer can go forward.

Apple featured a 10-year-old boy singing the Oscar-winning theme song to the rapper’s movie “8 Mile” in an ad on MTV for the computer company’s iPod music player and iTunes music service.

On Monday, US District Judge Anna Diggs Taylor ruled that the suit brought by Eminem’s publishing company can proceed against several companies, including MTV parent company Viacom and advertising agency TBWA/Chiat/Day.”

Interesting how the people criticizing lawyers here aren’t suggesting what they would prefer in this situation. If Apple needed permission from Eminem and didn’t, in fact, get the permission, should Eminem not be able to address his grievance? Or if Apple either didn’t need Eminem’s permission or actually did get it, shouldn’t they be allowed to defend themselves?

To me, this seems like exactly the sort of thing that should be decided in court.

Actually, there is nothing illegal with a “cover” song as long as the lyrics remain the same.

Otherwise lawyers for major artists everywhere would make a killing off of bar bands…

I wonder if thats Eminem’s way of poking fun at the whole situation of using ones product without permission.  And Eminem’s career over?  All rap is about hoes, how many cars they have and how bad azz they are?  Someone really needs to get out more and get rid of that closed minded view.

I doubt Eminem himself woke up one morning and said, “I’m gonna sue Apple.”

It’s the company that publishes his music (i.e. his handlers) that are bringing on the lawsuit… Because more money equals more cocaine for them.

Ryan, what law school did you go to? It’s perfectly legal to perform any song you want, any way you like, in a public concert. It is not, however, legal to turn around and sell recordings of cover songs without permission from the songs’ copyright owners.

Apple screwed up if they didn’t get permission to use this track. Plain and simple.

Thanks Ryan. Notice that they didn’t use any Eminem recording.  It was a 10-year-old singing the song. I think I’m going to tape myself against a white background and singing “Slim Shady.” So are you going to sue me, Em?

Even if suing Apple makes sense, why are you suing MTV for showing the commercial? That doesn’t make sense unless if you sue every network that carried the commercial. I know I saw it on TV, and I don’t watch MTV. Where’s ABC’s lawsuit??
