I bought a 3 generation ipod on ebay and the battery died on me quickly. Does any of this cover me?

My computer’s hard drive crashed and I lost everything on my itunes. It was covered under warranty so i got a new computer but how do i get the songs on to my new itunes from my ipod? please help
