France Telecom’s Orange brand has failed to regain its iPhone exclusivity in France after the Paris Appeal Court confirmed a French Competition Council ruling that the exclusivity agreement with Apple was to be suspended.
The Competition Council previously said that the five-year deal was “clearly excessive” and that it risked “serious and immediate damage to competition on the mobile market and to consumers.” France Telecom, which has argued the watchdog had “put the market economy into question”, told Reuters it was “surprised” at the failure of its appeal and will now appeal to France’s highest court, the Cour de Cassation.
